Basic Terms of Use

1. BINDING EFFECT

This agreement (“Agreement”) is a binding agreement between you (“you”) and FitWithAbhishek (“Company,” “we,” “us,” or “our”). By using the website www.fitwithabhishek.com (the “Site”) or any information, materials, images, graphics, data, text, files, links, software, messages, communications, content, programs, workout plans, meal plans, coaching systems, and other materials related to the Site (collectively “Content”) or services provided in connection with the Site (the “Service”), you agree to abide by these Terms & Conditions, as the Company may amend them from time to time in its sole discretion.

BY USING THE SERVICE, YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OLD AND LEGALLY ABLE TO ENTER INTO THIS AGREEMENT.

2. REFUND POLICY / CANCELLATION

Due to the nature of digital fitness programs, online coaching, workout plans, and meal plans, access is granted immediately upon purchase.

  • Digital programs, downloadable workout plans, and diet charts are non-refundable once accessed or delivered.

  • Subscription-based services may be cancelled at any time by contacting Customer Support at ap380896@gmail.com

  • If a specific program includes a refund window, eligibility will depend on compliance with program requirements as communicated at the time of purchase.

All refund decisions are made at the sole discretion of FitWithAbhishek.

3. PRIVACY POLICY

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into this Agreement by reference. By using our Site and Services, you agree to the collection and use of information in accordance with our Privacy Policy.

4. SUBSCRIPTIONS / AUTO-RENEWAL

If you purchase subscription-based coaching or membership programs:

  • You authorize automatic recurring billing using your selected payment method.

  • Monthly subscriptions are billed every 30 days.

  • Annual subscriptions are billed once per year.

  • Payments are non-refundable once billed.

You may cancel by emailing ap380896@gmail.com before your next billing cycle.

5. LICENSE

FitWithAbhishek owns or licenses all intellectual property related to the Site, Content, and Services, including workout programs, branding, videos, PDFs, graphics, logos, and coaching systems.

You are granted a limited, non-transferable, revocable license to access and use the Site and Services for personal, non-commercial use only.

You may NOT:

  • Copy, distribute, resell, or reproduce our programs

  • Share login credentials

  • Modify or create derivative works

  • Use content for commercial resale

All rights not expressly granted remain reserved.

6. CONFIDENTIALITY

All proprietary methods, systems, training materials, coaching frameworks, and business processes are confidential information.

You agree not to:

  • Share paid program content publicly

  • Distribute workout or diet plans

  • Record or resell private coaching calls

Violation may result in immediate termination of access without refund.

7. USE OF THE SITE AND SERVICES

You agree not to:

  • Interfere with website functionality

  • Attempt unauthorized access

  • Use automated tools (bots/spiders)

  • Impersonate others

  • Upload harmful or illegal content

  • Engage in harassment or defamatory behavior

Any misuse may result in permanent termination of access.

8. HEALTH & FITNESS DISCLAIMER

FitWithAbhishek provides fitness and wellness education. We do not provide medical advice.

You acknowledge that:

  • Results vary based on effort, body type, health condition, and consistency

  • You should consult a qualified physician before beginning any exercise or nutrition program

  • You assume full responsibility for your participation

We are not liable for injuries, health complications, or adverse outcomes.

9. USER CONTENT

If you submit testimonials, transformation photos, comments, or reviews:

  • You grant us a worldwide, royalty-free, perpetual license to use such content for marketing and promotional purposes.

  • You confirm you own or have rights to the content submitted.

We are not obligated to publish any submitted content.

10. INTELLECTUAL PROPERTY COMPLIANCE

You agree not to infringe upon copyrights, trademarks, or proprietary rights.

All trademarks, service marks, logos, and branding associated with FitWithAbhishek are protected by law.

11. INAPPROPRIATE CONDUCT

You agree not to:

  • Post defamatory or abusive content

  • Spread misinformation about programs

  • Harass team members or other users

  • Engage in misconduct within private communities

Access may be revoked without notice for violations.

12. TERMINATION

We reserve the right to suspend or terminate your account at any time if you violate these Terms.

Upon termination:

  • Your access to programs and materials will cease immediately.

  • No refunds will be issued unless otherwise stated.

13. DISCLAIMER OF WARRANTIES

All Services are provided “AS IS” and “AS AVAILABLE.”

We make no guarantees regarding:

  • Specific fitness results

  • Weight loss amounts

  • Muscle gain

  • Performance outcomes

Individual results vary.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, FitWithAbhishek shall not be liable for:

  • Indirect or consequential damages

  • Loss of profits or business

  • Injuries arising from exercise participation

Our maximum liability shall not exceed the amount paid by you in the preceding two months.

15. INDEMNIFICATION

You agree to indemnify and hold harmless FitWithAbhishek and its team from claims arising from:

  • Your misuse of the Site

  • Violation of these Terms

  • Injury resulting from improper exercise execution

16. GOVERNING LAW

This Agreement is governed by the laws of India.

Any disputes shall first attempt resolution through mediation. If unresolved, disputes shall be subject to arbitration or courts within India.

17. MODIFICATIONS

We may update these Terms at any time. Continued use of the Site constitutes acceptance of revised Terms.

18. ENTIRE AGREEMENT

These Terms constitute the full agreement between you and FitWithAbhishek regarding use of the Site and Services.

19. REFUND POLICY

By accepting these Terms, you also agree to our Refund Policy (if applicable).
